Terms of Service

These Terms of Service (the "Terms") govern your use of Scrywire — the website at scrywire.com, our subdomains, and any related services (together, the "Service"). The Service is operated by Average Build LLC, a limited liability company ("Scrywire", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use Scrywire
You must be at least 13 years old to use the Service, and at least the age of digital consent in your country (16 in much of the EU/UK). If you are under 18, you must have permission from a parent or legal guardian. The Service is not directed to children under 13, and we do not knowingly collect information from them.
You're responsible for everything that happens under your account. Keep your credentials secure and don't let anyone else sign in as you.
2. What Scrywire is (and isn't)
Scrywire is a matchmaking and webcam platform for trading card games. You bring the cards, the camera, and the rules; we help you find a pod and connect. We are an independent service. We are not affiliated with, endorsed by, or sponsored by Wizards of the Coast, The Pokémon Company, Konami, Disney, Bandai, Legend Story Studios, or any other game publisher. All game names, formats, and related marks are the property of their respective owners.
Scrywire is not a game-rules authority. Disputes about rulings, legality, or banlists are between you and the other players at your table.
3. Your account
To host or join a table you may need to register an account. You agree to provide accurate information and to keep it current. You can delete your account at any time from your profile; some content may remain in backups or in pods you created until retention windows elapse.
4. Tables, calls, and recordings
Webcam video and voice are transmitted peer-to-peer or via third-party infrastructure for the duration of a table. Scrywire does not record your calls. If you record a call — locally, with OBS, or otherwise — you are responsible for getting the consent that your jurisdiction requires from the other players, and for handling the recording lawfully thereafter.
Treat every table as a public-facing space. Don't show personal documents, addresses, or anything you wouldn't want strangers to see.
5. Your content
"Your Content" means anything you submit to the Service: profile details, table titles and descriptions, chat messages, avatar images, and the audio/video you transmit during play. You retain ownership of Your Content.
You grant Scrywire a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), and display Your Content solely to operate, secure, and improve the Service. This license ends when you delete the content or your account, except to the extent the content has been shared with others who have not deleted it, or where retention is required by law.
You represent that you have the rights to submit Your Content and that it doesn't violate anyone else's rights or the Acceptable Use Policy.
6. Acceptable use
Our Acceptable Use Policy is part of these Terms. In short: don't be a jerk, don't cheat, don't harass anyone, don't post illegal content, and don't try to break the Service. We can suspend or terminate accounts that violate it.
7. Third-party services
The Service relies on third-party providers for hosting, authentication, real-time communication, email, and analytics. Their terms and privacy practices apply when their services are used. See the Privacy Policy for an up-to-date list of subprocessors.
8. Paid features
Scrywire is currently free to use. If we introduce paid features, subscriptions, or in-app purchases, those will be governed by additional terms presented at checkout, and you'll be charged only for what you explicitly buy.
9. Intellectual property
The Service — including the Scrywire name and logo, the website design, code, and original content — is owned by Scrywire and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, scrape, resell, reverse engineer, or create derivative works of the Service, except where permitted by law.

10. Termination
You can stop using the Service at any time. We can suspend or terminate your access — temporarily or permanently — if we reasonably believe you've violated these Terms, abused the Service, or created risk for us or other users. We'll usually try to give notice, but we don't have to where doing so would be impractical or unlawful.
11. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Scrywire disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about uptime, the behavior of other users, or the quality of webcam connections. We don't guarantee that a table will be available, that a pod will be civil, or that the cards in question are legal.
12. Limitation of liability
To the maximum extent permitted by law, Scrywire and its operators will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of profits, data, goodwill, or game results — arising from or related to the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid Scrywire in the 12 months before the claim, or (b) USD $50.
13. Indemnity
You agree to defend and indemnify Scrywire from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
14. Changes to the Service or Terms
We may change the Service at any time. We may also update these Terms; if changes are material, we'll let you know in-app or by email at least 14 days before they take effect. Continued use after the effective date means you accept the new Terms.
15. Governing law and disputes
These Terms are governed by the laws of the United States and the state in which Average Build LLC is organized, without regard to conflict-of-laws principles. You and Scrywire agree to submit to the exclusive jurisdiction of the state and federal courts located in that state for any dispute, except that either party may seek injunctive relief in any competent court to protect its intellectual property rights. Nothing in this section limits any consumer rights you have in your country of residence that can't be waived by contract.
16. Miscellaneous
These Terms are the entire agreement between you and Scrywire about the Service. If a court finds part of them unenforceable, the rest remain in effect. Our failure to enforce a right isn't a waiver of that right. You can't assign these Terms; we can assign them to a successor as part of a merger, acquisition, or sale of assets.
