Scrywire respects intellectual property rights and expects users to do the same. This page explains how to send a takedown notice under the U.S. Digital Millennium Copyright Act ("DMCA") or report a trademark issue, and how we respond. Equivalent processes apply for other jurisdictions.
1. Reporting copyright infringement
If you believe content on Scrywire infringes a copyright you own or are authorised to enforce, send a written notice to dmca@scrywire.com containing all of the following:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material that is claimed to be infringing and where it appears on Scrywire — a direct URL is best.
- Your contact information: full name, mailing address, telephone number, and email.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner's behalf.
Misrepresentations in a DMCA notice can expose you to liability under 17 U.S.C. § 512(f). If you're unsure whether something infringes your rights, please talk to a lawyer first.
2. What we do with notices
When we receive a valid notice we will, within a reasonable time:
- Remove or disable access to the reported material.
- Notify the user who posted it and forward your notice (minus your phone number) so they can respond.
- Terminate, in appropriate circumstances, accounts of users who are repeat infringers.
3. Counter-notices
If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to dmca@scrywire.com including:
- Your physical or electronic signature.
- Identification of the material that was removed and the location it appeared at before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the district where you live (or, if outside the U.S., the federal court of any judicial district in which Scrywire may be found), and that you will accept service of process from the person who filed the original notice.
We may restore the material 10 to 14 business days after receiving a valid counter-notice, unless the original complainant files a court action seeking to restrain the user.
4. Trademarks
To report trademark infringement, email dmca@scrywire.com with the trademark, the registration number (if applicable), and the URL of the infringing content. Note that descriptive or nominative use of a game's name — for example, calling a table a "Commander pod" — is generally not infringement.
5. Game publishers
Scrywire is independent and not affiliated with any TCG publisher. Game names, format names, and related marks belong to their respective owners. We act on valid takedown notices from rights holders or their authorised agents.
